Netherlands Regulator Issues Warnings to 13 Sites for Violating Payout Regulations

The Netherlands gambling authority, de Kansspelautoriteit (KSA), has warned 13 online gambling providers against obstructing and delaying payouts to its customers.

According to the KSA’s announcement, a study of online gambling license holders revealed that 13 operators placed illegal conditions on their payout processes. 9 of those operators have been informed to remove these conditions immediately while a further 4 operators are under suspicion. The 4 operators under suspicion have been requested to inform the KSA of their processes for payouts and if any conditions exist, to remove those conditions with immediate effect.

Payout Rules

Under the Remote Gambling Act (KOA: Wet kansspelen op Afstand), all gambling license holders in the Netherlands are obliged to fulfill any withdrawal requests from their customers within a reasonable timeframe and without any unnecessary delays. There must be no conditions for completing this process.

The KSA has also stated that there must be minimum withdrawal amount or wagering requirements before a payout is issued.

Breaches

The regulator has implemented systems that trigger signals if a customer is experiencing any delays or difficulties when seeking payouts. These signals were triggered by 9 gambling operators and informed the license holders of the issue. However, the KSA continued to receive signals that illegal conditions on payouts were in place and have now reprimanded the operators.

No signals were received from the remaining 4 gambling operators, but the KSA has requested that all 13 providers must confirm in writing that they do not use minimum amounts or wagering requirements when processing payouts.

According to the latest Netherlands Gambling Statistics, there are 27 licensed online gambling operators in the Netherlands who combined to generate €1.39 billion in the 2023 calendar year.

Average customer losses per month amount to €160 per person while there are around 1.1 million active customer accounts in the Netherlands.

The Netherlands Gambling Authority (KSA) recently issued warnings to 13 online gambling sites for violating regulations related to payouts. The regulator found that these sites were not adhering to the rules set forth in the country’s Remote Gambling Act, which went into effect in April 2021.

Under the Remote Gambling Act, online gambling operators in the Netherlands are required to provide timely and accurate payouts to their customers. This includes ensuring that winnings are paid out promptly and in the correct amount. Failure to comply with these regulations can result in penalties and sanctions from the KSA.

The KSA identified a number of issues with the 13 sites that were warned, including delays in processing payouts, incorrect payout amounts, and failure to provide adequate customer support for payout-related inquiries. The regulator has given these sites a deadline to rectify the issues and come into compliance with the regulations.

In addition to issuing warnings, the KSA has also reminded online gambling operators in the Netherlands of their obligations under the Remote Gambling Act. The regulator has emphasized the importance of transparency and fairness in payout practices, and has warned that operators who fail to meet these standards will face consequences.

The KSA’s actions are part of a broader effort to ensure that online gambling in the Netherlands is conducted in a safe and responsible manner. The regulator is committed to protecting consumers and preventing problem gambling, and is actively monitoring operators to ensure compliance with the law.

Overall, the warnings issued by the KSA serve as a reminder to online gambling operators of the importance of following regulations related to payouts. By adhering to these rules, operators can help create a safer and more transparent online gambling environment for players in the Netherlands.
